The internet and various news outlets are ablaze following the Pentagon's recent statement threatening soldiers with prosecution for promoting their religious faith. As cited in Breitbart News, Charismanews.com, and various other sites, the Pentagon declared: "Religious proselytization is not permitted within the Department of Defense... Court martials and non-judicial punishments are decided on a case-by-case basis." According to Fox News, the statement was developed following a meeting between members of the Obama administration and Mikey Weinstein, head of the Military Religious Freedom Foundation. The purpose of the meeting was to develop court martial procedures against Christians in the military who either express or share their faith. According to Weinstein, as cited by Charisma News, Christians who share their faith in the military are enemies of the Constitution and are guilty of treason. Understandably, Christians and conservative websites are deeply disturbed by this development. Chaplains in particular are troubled. However, few reports have examined the implications of this Pentagon statement, should it be put into practice. I have a certain unique perspective on this issue because I am a chaplain. I serve as police chaplain in Montgomery County, Ohio. I am endorsed by Regular Baptist Chaplaincy Ministries, affiliated with the General Association of Regular Baptist Churches. I participate with Police And Clergy Together as an auxiliary to the Dayton Police Department, Dayton, Ohio. I am a recipient of the Optimist Club 2013 Law Enforcement Award "for distinguished and dedicated service." My opinions are in no way a reflection of the agencies with whom I work, or the Optimist Club, but I think I know this issue better than most people. Several problems about the Pentagon's statement need to be considered: It is a violation of the Constitution Contrary to statements about the "Constitutional" separation of church and state, the Constitution makes no such declaration. Article I states in full: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people to peaceably assemble, and to petition the Government for a redress of grievances." Why are all these rights contained in one article? Because to deny or inhibit the free exercise of religion automatically affects the other rights as well. They go together, stand together, or fall together. To deny me the "free exercise" of religion and speech is to violate my civil rights, and the rights of those who assemble to hear me. It violates Chaplain confidentiality The most important question I am asked by police officers is "Is this confidential?" If the matter is not illegal, I never discuss or divulge the content of our conversations. The government has no right to know - or judge - whether I am discussing religion, marriage, employment or any other private matter. The officers are entitled to have their privacy protected. Frankly, I never discuss controversial topics while on duty. I defer complicated questions to off-duty hours for a simple reason: We can't afford to be distracted while on duty. When I am in a police cruiser, I am totally on duty; I am there to assist the officer and keep him safe. I discourage officers from deeply personal matters until down time when we are in a safe environment. But whenever the officer opens up his life, he needs to know he can ask anything, and I will help without violating his rights. It violates accepted standards of conduct Both military and police agencies allow chaplains the right to exercise their office in appropriate ways. If I officiate a meeting in which officers are required to attend without alternative, I respectfully restrain my comments to accommodate those who are uncomfortable in that setting. If I am asked not to mention Jesus directly, I don't make that an issue. I can acknowledge Deity in a number of ways that conform to the standards place upon me. If I am in a meeting where officers are free to come and go, or where they attend voluntarily, I have greater freedom to express my religious views without violating department policy. Personally, I address most religious matters within my church rather than while on duty. The officers know where I pastor and they frequently attend my church. In all the time I've served as police chaplain, I've never had a single complaint about how I function on the job. It violates my duty As an officer of the department, I am duty bound to uphold the laws of the state and the Constitution of the United States. To suggest that a chaplain is committing treason while fulfilling his official duties is ludicrous. If a chaplain is not present for religious purposes, why is he called a chaplain? Chaplaincy has a legitimate place within the military and law enforcement because both duties involve life - threatening responsibilities and traumatic conditions. To deny a chaplain's ministry is to abuse our service personnel. If chaplains cannot function within the police and military, those agencies most committed to our protection, then religious freedom cannot exist anywhere for the rest of America. Ultimately, all our rights are at stake. That is the true threat from the Pentagon's latest move. |
